Dear All:
Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.
The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.
Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.
What are my options for re-entering?
1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?
What do you think my best option is or am I out of luck?

If I take a training course from Sun microsystems by paying them when I am on H4, is it illegal?
Technically, before October 1st - there is no employee-employer relation. It can be a trainer-trainee relation like Sun example above.
Also, please don't forget to consult a good lawyer when you have any questions about whether anything is legal or illegal.

I am not a perm candidate and I dont know what is causing the failure of First-in-first-out procedure.
We are going to demand TRANSPARENCY in addition to efficiency for BECs. Its a part of Immigration voice's agenda.
The way things are going, even if you get your labor approved, there will be a new backlog. That will be at 485 stage.
And then 2 years down the road, there will be a backlog elimination center for the I-485 as visa numbers would be available but the self-appreciating and self-congratulating govt agencies would continue doing the great job they are doing today. At least people with lesser patience will be able to go for consular processing.

Hi,
Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

I have applied I 140 on Jul 6th and got the APPROVAL on Jul 18th from Texas centre :) ... never got a receipt notice... but i know of some of my friends who got a receipt notice before approval ..

Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.

I guess we should send this to Lou Dobbs and Mr. Grassley too !! This is highly unfair - only American citizens should be allowed in NBA, MLB , NFL etc etc. :D
Just let them bring a resolution and next year half the teams would be empty.;)

I am on L1B and working in US for last 3 1/2 years. My L1 visa will expire in Jun 2011. In between another company is ready to sponsor H1B for me and it will file it in April 2010. So here are my questions.
1. From when i can start working with new company on H1 ? From Jun 2010 (after getting H1 approval) or will have to wait till Oct 2010 ?
2. What will be the duration of my new H1B visa, considering i already used 4 years of my L1 ? Is it 6 years or only 2 years ?
Thanks for your expert advice.

She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?
