Interesting findings in the USCIS Ombudsman report - 2007.

Employment-Based (EB) Green Card Applications
(Annual Report pp. 32-37)
In FY 06, over 10,000 visas were lost because of slow processing of EB cases, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards. As of May 2007, the
State Department estimated that 40,000 EB visas may be lost in FY 07 if USCIS does not increase the
processing rate for green card applications. The Ombudsman attributes the slow rate of adjudications to inaccurate statistics and inefficient USCIS management of its workload. The problem will become significant in the coming fiscal year if there is a dramatic increase in EB green card applications, and a significant backlog is likely to develop if this problem goes unaddressed.

My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

You can say like....around Oct-15-2007 or so. This letter is on top of Passport, birth certificate and PR card.

My 6 year term of H1b is between 2004 Oct till 2010 Sep
My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.
I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...

If not and your labor certification is approved and the I-l40 is pending then you can only request an extension in one (l) year increments only until a final decision is made.
So does this mean I can only request for a 12 month extension if labor/I-140 is pending on Nov 2008?

I'm on currently on H1b (NO EAD). I'm applying for another job with a different company and came across the below question in thier Job Application. I don't know if the other company is willing to transfer my H1, but I would like to apply and prove myself in the interview.
If hired, can you submit verification of your legal right to work in the U.S.?
Should the answer be YES or NO? Can my current H1 be used as a proof of legal right to work???
I'm also required to acknowledge the below statement as part of the application.
I am aware that, as a condition of employment, if employment is offered, I must be authorized to work in the U.S. and demonstrate that authorization as required by the Immigration Reform and Control Act of 1986.
Appreciate if anyone of you can clarify this.

I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

Applied for EAD renewal on 6/11/2008. Should I get it for 2 years or 1 year.
My understanding is everything that gets processed after 6/30/2008, will be for 2 years.
My PD is 6/12/2006, EB2 - which is not current right now, and I don't expect it to be current, until my I-765 gets processed (Well if it becomes current I guess I don't need 2 years :) )

Ask your company if they can do your H1 extension under CORP thus the legal entity does not change and there should be no issue.
It seems like for your initial H1, it was a mistake on their part that they filed you H1 under CORP while you were actually paid by the BANK. Can you ask them why they did that in the first place?
If it's a mistake on their part, there's no reason why you should suffer and they must take every effort to help you out. Work with them, talk to your manager, his/her manager and explain them the issue. It's an internal thing and I'm sure can be worked out.

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

Hey people , i need help. as EB-3 is current , my spouse who is on H4 ,applied for change of status(H-4 to F-1) ,so can i file her papers along wth mine in I-485 or not? change of status is in process.

If you can then retract her COS application and include her in 485. But I am not sure how you would go about donig that. Check with attorney.

3. I wanted to capture that but my company lawyer said no stick with EB2.
