I am bumping this poll up again so that it gets more visibility now as many folks are trying to check for VB updates.

Yeah, right, first u need to find out which 140 was withdrawn. If the approved one is withdrawn, u r safe based on the fact that the same 140 was used with 485.

Hi,
At present I am on H4 but my H4 expired in December2006. But I have I-94 valid till 2009. My husband also got extension till April2009. Now I want to apply for H1 in April2007. I want to know whether this will affect my H1 approval? Do I need to have stamped H4 which is valid till 2009 before filing fresh H1?
I need this as soon as possible.

... But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
I think this issue used to be there. Why do you think otherwise? COS is not computerized to happen on Oct 1. It is manual process, while approving H1B, it is done. When someone enters after that on H4, then that COS is overwritten.
What lawyer is telling in this regard?

All,
Today my attorney informed me that TSC approved my I-140. Sighhhhhh.... Approval notice has Notice Date of September 18th. My employer did not receive their copy to date. Ofcourse, I was doing my daily ritual, anxiously checking status several times a day.
USCIS website still showing "Case Received and Pending", ever since I received my receipt to date. Also my 9th year H1 extension for which I received approval notice almost 5 months back, still shows 'Case Received and Pending' to date.
I know many of us praying for a LUD, checking status several times a day. But also check with your attorney/employer as this website status thing appears another USCIS blooper.

I would suggest you to call up USCIS and tell them about your situation. I am sure they will advice you to what to do next.

The first picture isn't as good as the others, because it's too dark in the face. You need to wait for the light to hit their face some, and then snap. Harder to do, than to recommend, really.

Yes you can go to school part time on H1 for MBA. Some states allow you to claim in state tuition on H1 for state schools - that will significantly reduce the tuition bill. In addition Federal govt allows either a deduction of $4k / yr or a credit of up to $2 k / yr (search for tuition tax deduction and Lifetime Learning credits).

I did my MBA in MI and i got instate tuition too .....
Lot of states give Instate Tuition for H1B and H4 people just check with your university.......

Today my lawyer sent me my receipt numbers for 485, EAD and AP. when I enter my AP receipt number to check online status I see the following...
Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION
Current Status: Card production ordered.
On August 30, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Anyone know what this means... It doesn't say I-131 in application type..

Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
On August 23, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense. Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.
My lawyer says the checks have been cashed and we have proof of this.. She says it can be a typo..
Most weird part is for my EAD it says card has been ordered.. but I haven't even done finger prints and my 485 is in suspense..

My wife is on H4 and with recent events, we applied for EAD. Our EAD was approved a month ago. I recieved mine but my wife did not. When checked with USCIS, they informed I have to wait for 30 days.
It would be great if the group can share thier experiances or has any advise on this issue?

how is it possible to change jobs while the GC application is pending (part of the July 07 madness). Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?
