We are going to demand TRANSPARENCY in addition to efficiency for BECs. Its a part of Immigration voice's agenda.

Is there ANY mechanism right now for applicants or their attorneys to find out what's going on with their PERM application? Is there a phone number you can call or an email address you can write to? It seems that at a minimum the processing centers should issue a monthly report on the progress and issues encountered.

Hi All,
I recently noticed the Audited Dates for PERM moved up nearly by 9 months to Dec 2009.
My labor filed in June 2009 has been in audit.
My employer is telling that that still my case is in process.
Has any body filed in 2009 and been in Audit got it approved recently?

Those of you who have audited PERMS should check with the employers as the employers may not be checking the status regularly. Please do post if you have any updates.

but this serge in processing more Citizenship cases will indirectly slow down 485 approvals due to lack of staff and may result in wastage of visas again for FY 2008.

I think this memo is about NATURALIZATION - so yes it's about Citizenship, not for GCs or I-485s.

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?
Your advices are appreciated

Applying AC21 will trigger the IO to update the case, and if all is fine, in some case, the case could be approved, though not at all time, You can try your luck, In July when all cases were current happened to a colleague with PD2004, the case was approved in a week after mailing AC21. Check with an Attorney.

You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

can you really claim refund? Is there any rule?

It is specifically mentioned in the forms and online when you file for any applications that USCIS is unable to process any refunds requested by applicants regardless of an error in the application, withdrawal of application or an error on the USCIS's part. The wordings may not be exactly the same but in a nutshell they are saying "NO REFUNDS!!!"

I noticed it when I applied for EAD online and thought I goofed up the application and see what my options are.

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

FATCA establishes a MINIMUM penalty of $10,000 for failure to report foreign ASSETS over $50,000 on your tax return. FATCA filing is required in addition to FBAR filing. Who ever filed FBAR, please be aware of this new law from next year onwards , since the penalty is so high.

As far as i know, it dosent matter if you are on EAD or H1b. You can open a bussiness as a investor. You can have profit of that business but you can not generate your payrole or you can not work for that particular business. I will recommend to assist immigration lawyer or CPA.
